WHAT WE DO
Indirect Tax and VAT Advisory
We advise on Dutch VAT and wider indirect tax issues that affect day-to-day trading, cross-border supplies, imports, exemptions and input VAT recovery. The focus is not only on the technical answer, but on whether the position works in practice for contracts, invoicing, reporting and operational execution. Where needed, we connect VAT with customs, corporate tax and transfer pricing, working alongside our corporate tax compliance team where the wider structure requires it.
VAT Compliance Services
We provide end-to-end Dutch VAT compliance services, covering periodic VAT returns as well as the additional filings and reporting obligations needed to maintain full Dutch and EU VAT compliance.
VAT Registration in the Netherlands
If your business carries out taxable activities in the Netherlands, whether through a Dutch branch or subsidiary or as a business not established here, a Dutch VAT registration may be required. We assess the position, manage the application, and help ensure the registration fits your operating model from the outset. Through our international network, we can also help coordinate wider European VAT registrations where needed. This is particularly important for foreign businesses and Dutch subsidiaries that need to establish a compliant VAT position from the outset.
VAT Returns
We prepare and file Dutch VAT returns end to end, from data review through to submission. Once the process is aligned with your ERP or reporting systems, filings can run on a clear timetable and with less disruption internally. If corrections are needed, we also handle supplementary returns and follow-up with the Dutch tax authorities.
Annual VAT Recovery Adjustment
Where a business carries out both VAT-taxable and VAT-exempt activities, input VAT recovery needs to be calculated carefully. We perform the annual deductibility calculation, apply the correct method and document the outcome clearly. Provisional percentages used during the year can then be reconciled against the final position, helping keep adjustments accurate and supportable.
Year-End Corrections
At year-end, Dutch VAT rules can require corrections for private use, mixed-use costs and other specific adjustments, including the BUA regime where relevant. We assess the applicable corrections, calculate the amounts and make sure they are reflected correctly in the final VAT return, so the year-end VAT position is compliant, accurately reported and supported by appropriate documentation.
VAT Reporting in the Netherlands
VAT reporting often extends beyond the periodic return. We help manage the related filings that support a complete Dutch and EU VAT compliance position.
EU Sales Listing (ESL / Opgaaf ICP)
For companies performing cross-border B2B sales, we prepare and align the EU Sales Listing with the VAT return and the underlying transaction data. We also help ensure that the legal conditions for applying the 0% VAT rate are met and consistently supported by the underlying documentation.
Intrastat Reporting
Where the physical flow of goods crosses Dutch borders within the EU, statistical filings with CBS may be required. We help determine whether the thresholds are met, prepare the data and keep the Intrastat filings aligned with your VAT records and reporting process.
OSS Returns
For businesses making relevant cross-border B2C sales, we can assist with OSS registration and reporting and the related VAT treatment across jurisdictions. That includes compiling the data, applying the correct VAT rates, and keeping the return aligned with the underlying transactions.
Statistical Filings
Some businesses also face separate Dutch statistical reporting obligations on cross-border services or trade activity. We help determine whether those filings apply, prepare the data and keep the reporting aligned with the wider finance and tax process.
EU VAT Refund Request
Has your business in or outside the EU incurred VAT in EU member states other than the member state in which it is established? As an entrepreneur, you may be eligible to recover this VAT by applying for a special VAT refund. We can assist in determining your eligibility to reclaim the VAT and support you throughout the refund process.
VAT Fiscal Representation in the Netherlands
Fiscal representation opens the Dutch market to foreign businesses, turning complex VAT obligations into a workable entry point.
Fiscal Representation for VAT in the Netherlands
For foreign businesses entering the Dutch market, general fiscal representation can provide a practical route into the Netherlands. We support VAT registration, handle filings, and manage contact with the tax authorities where fiscal representation is needed or commercially helpful, especially for non-EU businesses using the Netherlands as an import or distribution hub.
Article 23 VAT Deferment Licence
Article 23 can significantly improve import cash flow by allowing import VAT to be accounted for through the Dutch VAT return rather than paid upfront at customs. We advise on availability, support the application process where relevant and help ensure the operational setup works in practice once the licence is in place.
Real Estate Transfer Tax (RETT)
Real estate transactions often require a combined VAT and RETT assessment. We advise on the interaction between the two, identify relevant exemptions or structuring points, and help make sure the tax position supports the commercial deal rather than cutting across it.

Cross-Border VAT for International Businesses
Cross-border VAT issues are rarely confined to one filing. Imports, intra-EU supplies, B2C sales, exempt activities, fiscal representation and cash-flow planning can all affect the Dutch position. We help connect those moving parts so the VAT outcome is technically correct, commercially workable and aligned with the wider group structure, especially where customs, transfer pricing or corporate tax also come into play.

Frequently Asked Questions
Do we need to register for VAT in the Netherlands?
If you make taxable supplies in the Netherlands, import goods here or carry out certain cross-border activities, a Dutch VAT registration may be required. The right answer depends on how the business operates in practice.
How often are Dutch VAT returns filed?
The Dutch tax authorities set the filing frequency, which is usually monthly or quarterly. We help establish the right cycle and keep the process on track.
What is VAT fiscal representation?
VAT fiscal representation allows certain foreign businesses to meet their Dutch VAT obligations through a local representative. It can be particularly relevant to non-EU businesses entering the Dutch market and needing practical VAT compliance support in the Netherlands.
What is an Article 23 licence?
It allows qualifying businesses to account for import VAT through the VAT return instead of paying it upfront at customs, which can create a meaningful cash-flow advantage.
Can you handle ESL, Intrastat and OSS reporting as well?
Yes. We can support the wider reporting obligations that sit around the Dutch VAT return and keep them aligned with the underlying VAT position.
Do you provide VAT advisory services for international businesses in the Netherlands?
Yes. KC Legal provides VAT advisory services for international businesses operating in or trading with the Netherlands, including guidance on VAT registration, cross-border transactions, reporting obligations and fiscal representation where relevant.
